In a detailed and forceful opening statement, prosecutor Scott Harmon outlined what he described as a coordinated and deliberate attack in the killing of rapper Julio Foolio on June 22, 2024, in Tampa, Florida. The prosecution argued that despite the planning behind the incident, the defendants ultimately became “sloppy,” leaving behind a trail of video and physical evidence that helped investigators reconstruct their movements before and after the alleged crime.
According to the presentation in court, multiple defendants — identified as Mr. Chance, Mr. Davion Murphy, and Mr. Gathright — were captured on video shortly after the incident as they prepared to leave a residence in Tampa and return to Jacksonville. This footage, shown to the jury, was introduced as part of the timeline establishing their post-incident movements and coordination.

Further surveillance evidence allegedly showed Mr. Chance, along with his girlfriend and Rashad Murphy, using an Uber service to travel approximately 208 miles back toward Jacksonville, specifically to an address associated with Mr. Gathright. Prosecutors presented this detail as part of a broader effort to demonstrate how the group moved between locations following the event.
A significant portion of the opening statement focused on Mr. Gathright’s actions after the alleged attack. Prosecutors claimed that he drove a Chevrolet Impala to his grandmother’s residence in Auburnale, where he reportedly took steps to clean the vehicle thoroughly in an attempt to remove potential evidence. He then allegedly switched vehicles, transitioning from the Impala to a Toyota 4Runner. These actions were presented as suspicious behavior consistent with an effort to conceal involvement.
The prosecution also laid out claims regarding the weapons used in the attack. According to Scott Harmon, the defendants utilized two high-powered rifles along with a modified automatic handgun equipped with brass catchers — devices designed to collect shell casings and prevent forensic recovery at the scene. These modifications, the prosecutor argued, demonstrated an awareness of forensic investigation methods and an intent to avoid leaving traceable evidence.
The nature of the attack itself was described as a calculated ambush. Prosecutors told the court that Julio Foolio, whose legal name is Charles Jones, was targeted while inside a vehicle and had no meaningful opportunity to defend himself. The attack was characterized as sudden, coordinated, and executed with speed and precision, leaving the victim unable to escape.
Additional forensic evidence was also highlighted during the opening statement. Investigators reportedly recovered Maxtech 9mm shell casings at the scene, a type of ammunition that was later allegedly linked to items found in Mr. Gathright’s vehicle during a traffic stop on June 26. This connection was presented as a key evidentiary link between the suspects and the crime scene.
In concluding remarks, the prosecution emphasized that the incident was not random or spontaneous, but rather a planned and organized operation involving multiple individuals working in coordination. Prosecutors argued that the defendants actively pursued the victim and continued their actions even as he attempted to flee, reinforcing their claim of intent to kill.
The trial remains ongoing, with further evidence and testimony expected to be presented as the prosecution continues to build its case against the defendants.
