The female security guard who lost her lawsuit against Cardi B over an alleged assault is demanding a retrial, Us Weekly can exclusively report.
On Friday, October 31, Emani Ellis, who claimed Cardi, 33, assaulted her while she was working at a medical office on February 24, 2018, argued there was an“irregularity in the process of the court” or jury.
As Us previously reported, on September 2, following a trial, a jury found Cardi was not liable for damages. Cardi adamantly denied she assaulted Ellis.
In her filing, Ellis claimed that on September 2, during the trial, Cardi threw a pen at a third party outside the courthouse. The pen did not appear to make contact with the man.
Ellis’ lawyer alleged, “The incident happened while she was on a lunch break during the trial. The incident caused another individual to get pushed and injured. It was also completely unlawful and disrespectful for [Cardi] to injure others during the trial” at the courthouse “which she did.”
In the motion, Ellis’ lawyer said he needed additional time to investigate whether the incident was witnessed by jurors. “Jurors would be intimidated if they had viewed this type of conduct.”
The incident where Cardi threw a pen was caught on camera. While being questioned outside the court, the entertainer was asked about her current pregnancy. “Cardi, insiders are claiming Offset is publicly bragging about getting you pregnant for the fourth time,” a man yelled at the “Bodak Yellow” rapper. “Do you foresee any paternity issues with Stefon Diggs?”

“Stop disrespecting me,” Cardi responded as she threw a marker at him. “Don’t disrespect me.”
“I still love you even though you just threw some stuff at me,” he replied. Cardi fired back, “I don’t care. You’re disrespectful. Don’t do that.” (During the trial, Cardi was pregnant but had not announced it. Cardi revealed she was pregnant with her boyfriend Stefon Diggs’ child on September 17 in a sitdown with Gayle King.)
“[Cardi] clearly feels she is above the law and can do whatever she wishes,” Ellis’ lawyer said. The motion also included various other accusations against Cardi’s lawyers.
In a separate filing, Cardi’s legal team claimed Ellis’ legal team violated the court order to not bring up certain topics during the trial. A judge has yet to rule on either request.
In her lawsuit, Ellis was seeking a reported $24 million in damages over the alleged assault by Cardi. She was awarded nothing following the trial.
Cardi testified that she was at the medical building where Ellis worked for an appointment with her obstetrician. She said she was pregnant at the time with her first child, but had not yet announced the news. She claimed she asked Ellis if she was recording her, which led to them arguing.
“I want to thank my lawyers,” Cardi said in a press conference following the trial. The singer also thanked the jurors as well as “everybody at home supporting me.”
Cardi also warned people who thought about bringing lawsuits against her.
“This time around, I’m going to be nice,” Cardi said. “The next person to try and do a frivolous lawsuit against me, I’m going to countersue and I’m going to make you pay.”
