Sh-o-ck Court Twist as Kyle Sandilands’ Documents Are Cleared for Use in High-Stakes Jackie O Showdown
The beleaguered owner of KIIS FM has had a small legal win after the Federal Court ruled it could use documents from Kyle Sandilands’ abandoned lawsuit in its defence against Jackie ‘O’ Henderson.
Justice Angus Stewart confirmed on Friday that affidavits filed by Sandilands and his manager Bruno Bouchet were submitted voluntarily on the same day the former breakfast shock jock reached a $12 million settlement with ARN, meaning they are not protected from use in Henderson’s separate claim.
Henderson, 51, is suing ARN for wrongful termination and a contract payout of at least $82 million.
Sandilands’ lawyers opposed the move but did not appear. Henderson’s lawyers did not object.
ARN plans to rely on the affidavits — understood to outline the breakdown between the former co‑hosts — as it fights Henderson’s ongoing case.
Henderson’s dispute remains active despite Sandilands settling his own fight with the network and being terminated in March after failing to address what ARN labelled “serious misconduct” towards his co-host following an on‑air confrontation.
Sandilands has since shifted to a subscription‑based venture, Kyle Sandilands Live, launching next month.
He has recruited several former KIIS FM staff and released a trailer for a tell‑all docuseries, saying he will explain “what actually really happened”, while insisting he still wishes Henderson well.
Henderson’s trial is expected to begin in October.
