Radio host Jackie O Henderson’s statement of claim has revealed that she was fed up with the way Kyle Sandilands spoke to her on-air in several separate incidents since 2025.
In the bombshell statement of claim, tendered to Federal Court, Henderson claims that she had an “entitlement” to a workplace where safety risks (including psychosocial) were assessed, controlled, and otherwise eliminated or minimised to ensure her health and safety.
Included in the court document is a reference to a text message where Henderson claimed that she wanted Sandilands’ behaviour towards her addressed “because (of) complaints from listeners, calling it an abusive relationship, women especially”.
The statement of claim also reveals that Henderson was prepared to keep working for the network, but not doing breakfast. Instead, her contract was terminated by ARN.
Henderson is now seeking at “at least” $82 million in compensation.

Henderson’s statement of claim paints a staggering picture of what was happening behind the scenes before her termination on March 3.
The claim describes an on-air conversation between Henderson and Sandilands back on August 20, 2025 as “offensive and degrading”.
In the exchange, Sandilands poked fun at his co-star’s love of astrology and star-signs, calling it “psycho babble”.
He also said he was “worried” that she’d never end up with a romantic partner because of all the “requirements” she had.

At the time, Henderson told Sandilands not to “attack” her, and he quipped back, “this is talking, this isn’t attacking” and instructed her to stop using “hype words”.
According to the court document, Henderson even flagged that she felt “pushed” too far, and Sandilands later remarked to newsreader Brooklyn Ross, “All those books but has no idea.”
He also made a comment about her “period time”, according to the statement of claim.
Henderson also lists September 10, 2025 as a key moment in the her relationship with Sandilands.
During an on-air argument, Sandilands’ comments were “dumped” and censored.
Afterwards Henderson sent a message to Derek Bargwanna, the head of the KIIS network Australia, saying that she would not “be spoken to that way”, particularly off-air.
The statement of claim alleges that the KIIS boss replied that Sandilands was going to call her on-air and share “good news” that he lost weight because he “wants to be friends again”.

According to the court document, the next day Mr Bargwanna checked in on Ms Henderson and asked, “All okay?”
Henderson texted him again and said, “it’s fine today”, but asked him to make sure he spoke to chairman Hamish McLennan and then-chief executive Ciaran Davis.
The statement also outlines the incident on February 20 this year incident – the last time Henderson and Sandilands were ever on-air together.
During that argument, Sandilands claimed that Henderson’s “fixation” on astrology made her “almost unworkable” and claimed that she didn’t know what “was going on”.
Henderson said that she was offended, but Sandilands continued, saying that “everyone in this building” had mentioned to him she was not “doing the rest of the job”.
The court document outlines that Sandilands also swore several times during the change and despite Henderson being “visibly and audibly upset”, CBC did not “attempt to intervene” or stop Sandilands.
Henderson claims that she sent a text message on February 21 to CEO Michael Stephenson and chief content officer Kerri Elstub, describing her co-host’s behaviour as “unfair, inappropriate and completely unprovoked”.
She claims she also asked whether anything had been put in place “around boundaries and expectations moving forward”.

The statement of claim then outlines that Henderson’s media solicitors, HWLE Lawyers,
wrote to CBC and Australian Radio Network Pty on February 26.
The complaint letter outlined that Henderson had, on “previous occasions”, notified the network about Sandilands and his “bullying”.
The Complaint Letter stated that CBC had not implemented any control measures to
minimise the risk, and Henderson could not continue to work with Sandilands.
The Complaint Letter stated that Ms Henderson was willing to continue with the Agreement, but required CBC to propose an alternative to the Breakfast Show.
Henderson’s contract was then terminated on March 3 2026, and in the ASX statement, ARN claimed that Henderson had “given notice that she cannot continue” to work with Sandilands and accordingly ARN had “terminated” her contract.
The statement claimed that Henderson had been “possibly” considered for an alternative show.
It also said that Sandilands’ on-air behaviour on February 20th was “serious misconduct”; he was suspended, and later terminated.
