Tom Silvagni, the son of famous AFL couple Stephen and Jo Silvagni, sentenced to six years in jail for rape
When making the decision the judge said Tom Silvagni had ‘demonstrated no remorse’.
Tom Silvagni, the son of AFL great Stephen Silvagni and his celebrity wife Jo, has been sent to jail for six years and two months — with a non-parole of period of three years and three months — following his guilty rape verdict.
Tom, the youngest son of the couple and brother of AFL star Jack Silvagni, was convicted of two counts of rape on December 5.
The 23-year-old’s name had previously been suppressed but last week he was unmasked as the man who had raped his friend’s girlfriend in the early hours of January 14, 2024.
On Wednesday, he was sentenced to six years behind bars.
Judge Gregory Lyon took into account Silvagni’s age, his mental state, and the fact he had no prior convictions.
“Your prospects of rehabilitation are very good,” Judge Lyon said.


But the judge said he had “demonstrated no remorse” and did “not accept the wrongfulness” of his actions.
He also took into account the “deep shame” Silvagni would be feeling that would be undoubtedly contributing to his “depressive order”.
His parents Stephen and Jo, who were in the courtroom, did not react to the jail term.
After the sentencing, they were seen walking quickly away from the County Court in Melbourne but did not answer questions.
The rape occurred at the Silvagni home in Melbourne, on a night where the woman had been invited to the luxury house by her friend, who was also Silvagni’s girlfriend.
A friend of Silvagni’s, who had been in a brief relationship with the woman, was also at the gathering.
The four of them chatted for some time before they headed separately to bed with the victim having consensual sex with her boyfriend.
He then had to leave so he organised an Uber and left the property shortly before 2am.
Silvagni then went to the woman’s room and lied, claiming her boyfriend’s Uber had been cancelled and he would be back upstairs soon.
But it was Silvagni who went into the dark bedroom a short time later and pretended to be the woman’s boyfriend as he digitally raped her.
In a pre-sentence hearing last week, David Hallowes SC noted that Silvagni was a young man from a loving family with no prior convictions.
He also said Silvagni should receive a lighter sentence because his time in custody would be more difficult due to his poor mental health and risk of suicide.
Hallowes also read from a medical report that stated that Silvagni had a documented history of “suicidal ideation since childhood”, had had two hospitalisations for major depression and had an “actual overdose” in May, 2025.
The court heard that imprisonment posed “a clear and significant risk” for Silvagni and would have a significant adverse effect on his mental health due to depression and anxiety.

Stephen Silvagni is a legend of the Carlton Football Club, the club’s greatest full-back of all time, a five-time All-Australian and a dual premiership hero for the Blues.
His father, Sergio, is a former Carlton captain and also a dual premiership player.
Stephen has worked at various AFL clubs since he retired and is currently St Kilda’s list manager.
Jack Silvagni played 128 games for Carlton before joining St Kilda at the end of this year.
